Notice of Intended Marriage (NOIM) in Newcastle

The Notice of Intended Marriage or NOIM is the form that starts the legal marriage process in Australia. If you want to get married in Newcastle, you must give your NOIM to your celebrant at least one calendar month before the marriage date.

You can lodge it much earlier if you want to lock things in. The NOIM stays valid for 18 months from the date it is received.

The Timing Rule

The simplest way to think about it is this:

  • if your celebrant receives the NOIM on 17 March, the earliest marriage date is 17 April
  • if your celebrant receives it on 1 June, the earliest marriage date is 1 July

The date that matters is when the celebrant receives the correctly completed notice, not when you first enquire or pay.

What Goes on the NOIM

The form asks for details such as:

  • your full legal names
  • your dates and places of birth
  • your current residential addresses
  • your occupations
  • your parents’ names
  • whether you have been married before

The details should match your supporting documents as closely as possible.

Documents You Usually Need

Most couples will need to show:

  • proof of date and place of birth
  • photo identification
  • evidence ending any previous marriage, if relevant
  • translations for any document that is not in English

Who Can Witness the NOIM

Your signatures must be witnessed by an authorised person.

Common examples in Australia include:

  • a registered marriage celebrant
  • a justice of the peace
  • a lawyer
  • a medical practitioner
  • a police officer

If you are signing outside Australia, the witness must be someone authorised to witness NOIMs overseas, such as an Australian diplomatic or consular officer or a notary public.

Can the NOIM be Witnessed Remotely?

Yes. Since 12 June 2024, Australian marriage law allows a NOIM to be witnessed either:

  • in person, or
  • remotely by audio-visual link, if the legal witnessing requirements are met

That flexibility is helpful for couples who are interstate, overseas, or organising things quickly.

Can We Lodge the NOIM if One of Us Is Overseas?

Usually, yes. The key issue is that the NOIM must be correctly completed and properly witnessed. If one of you is overseas or unavailable to sign on the same day, speak with your celebrant early so the timing is handled properly.

What Happens After Lodgement?

Once the NOIM has been received:

  • the one-month notice period starts
  • your celebrant checks your documents
  • you keep working through any missing details
  • you move toward the ceremony date

Lodging the NOIM does not by itself complete the marriage. You still need the ceremony, the legal wording, and the signatures on the day.

There are limited situations where a shortening of time may be approved by a prescribed authority. This is not automatic, and it only applies in specific circumstances recognised by law.
